While every precaution has been taken in the preparation of this documentation, Real World Interface, Inc., assumes no responsibility for error or omissions, or for damages resulting from the use of the information contained herein.

Limits of Liability

To the maximum extent permitted by applicable law, Real World Interface, Inc., its officers, employees and contractors, and its suppliers, disclaim all warranties, either express or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, with regard to the hardware, software and all accompanying or subsequently supplied written materials and documentation.

To the maximum extent permitted by applicable law, in no event shall Real World Interface, Inc., its officers, employees or contractors, or its suppliers, be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption, loss of business information or other pecuniary loss) arising out of the use or of inability to use Real World Interface, Inc.’s, hardware, software, or documentation (in printed or electronic form), even if Real World Interface, Inc., has been advised of the possibility of such damages.

RWI, Inc. supplies its robots, associated and attached equipment, and software with the express understanding that all customers and users shall assume personal responsibility for taking all necessary and prudent precautions in the assembly, operation, transportation and use of same. An RWI, Inc. robot is a heavy piece of equipment and should be under strict control and supervision at all times, by properly trained and responsible operators. Robots should be operated in areas inaccessible to humans as much as possible, and never operated in areas that are routinely traversed by casual passersby, children or animals.

RWI, Inc.’s B-series robots are designed and intended for use exclusively indoors, in safe, secure environments protected from casual incursion by persons or other entities not involved in ongoing robot operations, and in environments free from all hazards that may harm the robot itself or cause it to be in a position that it might harm another piece of equipment or a person.

The responsible operator(s) shall be prepared, at all times, to hit the robot’s "kill button" immediately if the robot moves close to a person, fixture, piece of furniture, ramp, stairwell, uneven ground surface, ground surface that is wet or obstructed by cables or wires, or any other possible hazard, either to the robot, to other equipment, or to any person. The continuing safety of the robot, its operators, and all entities and equipment in the robot’s environment shall remain, at all times, the sole responsibility of the robot’s responsible operator(s).

Parts of the software distributed with RWI, Inc. robots have been developed and/or distributed as free research software, with the full permission of the original authors and/or developers. In no case shall any of these original authors/developers, any universities or other institutions with which they are currently associated, or any universities or other institutions with which they were associated at the time such software was written, developed or distributed, be liable for any damages whatsoever (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption, loss of business information or other pecuniary loss) arising out of the use or of inability to use any software distributed in conjunction with, or for use with, RWI, Inc.’s robots or their attached and/or associated equipment.

Special Note

Under no circumstances shall Real World Interface, Inc., nor its officers, employees or contractors, not its suppliers, take any responsibility whatsoever for support of any special orcustom modifications or alterations of any of its hardware or software products, or for any damages, losses or injuries of any kind or nature, (including without limitation, special, incidental, consequential, or indirect damages for personal injury, loss of business profits, business interruption, loss of business information or other pecuniary loss) arising from such modifications or alterations.

Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state/jurisdiction to state/jurisdiction.
